The time behind bars has already taken its toll on Ghosn.

Prosecutors say Ghosn underreported his income by about 5 billion yen ($44 million) over five years through 2015.

Ghosn is being held in a cell with a toilet and a wash basin. He declared his innocence at an open hearing at the Tokyo District Court on Tuesday that was held at his request to seek an explanation for his prolonged detention.

It's not uncommon in Japan for suspects to endure lengthy pre-trial detentions.

Under Japan's Code of Criminal Procedure, prosecutors can continue holding an accused person in custody if they indict the suspect within the detention period following an arrest.

Nissan said an internal investigation began in the middle of past year after whistleblowers came forward.

"We are fearful and very anxious his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment", she said in a statement.

Ghosn's wife said Thursday that she is "fearful and very worried" for his health after he developed a fever in jail. A doctor was tending to Ghosn, who has been worn down by the long detention and interrogations.

Ghosn has denied all of the allegations against him.

"We took these steps today because we believed that they are cases worthy of an indictment and going to trial", said deputy chief prosecutor Shin Kukimoto.

Nissan said earlier that its board had also met on Thursday, when directors had received "an updated report" on its own investigations into Ghosn's alleged misconduct. The prosecutors haven't officially charged him over these allegations.

At the court, Ghosn said his actions were backed by managers inside the company as well as external lawyers.

For example, his retirement payments were reviewed by legal experts inside Nissan as well as independent lawyers, and showed no intention of breaking the law.

Ghosn claims he has been "wrongly accused and unfairly detained".

But Ghosn's close aide Kelly, 62, who was arrested along with the former chairman for allegedly understating remuneration, has been released on bail, while denying the allegations.

While Nissan dismissed Ghosn as Chairman shortly after his arrest, Renault has retained him as Chairman and Chief Executive Officer, saying it needs evidence of his wrongdoing.
