Choose Your Own Adventure publisher sues Netflix over Black Mirror: Bandersnatch

In the film, Stefan (Fionn Whitehead) explained to his dad that the video game Bandersnatch is based on a book series which he described as "choose your own adventure".

According to Variety, Chooseco LLC, the Vermont-based publisher of the book series, claims Netflix "exploited the brand awareness of the book series to launch the show".

The popular on-demand video streaming service premiered Black Mirror: Bandersnatch in December past year.

Bandersnatch isn't the first instance of Netflix using interactivity in their content, with the platform previously including it in content aimed at children including Puss in Book: Trapped in an Epic Tale and Stretch Armstrong: The Breakout.

"On at least one occasion before the release of "Bandersnatch", Chooseco sent a written cease and desist request to Netflix asking Netflix to stop using the "Choose Your Own Adventure" phrase in connection with its marketing efforts for another television program".

The Choose Your Own Adventure series has sold more than 265 million copies worldwide. Chooseco filed a lawsuit in federal court today, saying that Netflix infringed on their trademark and is "causing confusion, tarnishing, denigrating, and diluting the distinct quality of the Choose Your Own Adventure mark".

The suit also notes that 20th Century Fox recently optioned the rights to create a film based on the series, which is now in the works.

Chooseco, which has owned the trademark since the 1980s, is claiming infringement, dilution and unfair competition and demanding at least $US25 million ($35 million) in damages or Netflix's profits, whichever is greater.

Chooseco printed over 620,000 copies of its Choose Your Own Adventure series for distribution across the nation past year, according to the lawsuit.
