President Trump on Monday night nominated Judge Brett Kavanaugh to the seat on the U.S. Supreme Court that Justice Anthony Kennedy will vacate at the end of the month. Kavanaugh and Gorsuch served as law clerks to Kennedy at the same time early in their legal careers.

Leo said Hardiman of Pennsylvania and Kethledge of MI are "a little bit less known by conservatives".

"This is a nightmare for red-state Democrats to oppose a highly qualified nominee, and all four of these people are highly qualified, been on the court, know what they're doing, mainstream judges", Graham said.

On Monday, Trump phoned retiring Justice Kennedy to inform him that his former law clerk would be nominated to fill his seat.

With Senator John McCain battling cancer in his home state of Arizona, Republicans can now only muster 50 votes.

Republicans have a 51-49 majority in the Senate.

The potential nominees were narrowed down from a list of 25 administration-approved judges, former judges and one member of Congress, as curated by Leonard Leo, executive vice president of the Federalist Society and Trump's top Supreme Court adviser.

Democrats have turned their attention to pressuring two Republicans, Sens. Lisa Murkowski, R-Alaska, and Susan Collins, R-Maine. Democrats are voicing alarm about what the new justice could mean for charged issues such as abortion rights and gay rights. At the top of that list is abortion. Although the statement is undoubtedly accurate, it is likely to be seized on by supporters of abortion rights as they try to convince moderate Republican senators that Barrett might vote to overturn the 1973 Roe v. Wade decision declaring a woman's constitutional right to abortion. Kennedy provided a decisive vote in 2015 on an important fair housing case.

"If confirmed to the D.C. circuit, I would follow Roe v. Wade faithfully and fully", Kavanaugh said. Kavanaugh has drawn concern from many in the conservative movement over some of his past rulings, notably his opinion against a Catholic pro-life organization in a case involving the Obamacare contraception mandate and an opinion that is said to have paved the way for the Supreme Court ruling that "saved" Obamacare itself a few years ago.
