German-born Kim Dotcom denies the allegations against him.
"I will appeal to the Supreme Court".
The decision whether to extradite Dotcom now rests with New Zealand's Justice Minister Andrew Little, however Dotcom has indicted he'll apply for leave to appeal Thursday's ruling at New Zealand's Supreme Court. Dotcom had built a massively successful company called Megaupload that had become a popular platform for illicit sharing of copyrighted movies.
The German national, who is accused of netting millions from his file sharing Megaupload empire, faces charges of racketeering, fraud and money laundering in the United States, carrying jail terms of up to 20 years.
The website attracted more than a billion visits and had more than 150 million registered users.
Of course, if the case against Dotcom et al ever does reach an American courtroom, they will claim that MegaUpload enjoyed safe harbour protection and therefore can not be held liable for any unlicensed content distributed over its networks by its users.
If sent to the U.S., he will face charges of racketeering, fraud and money laundering carrying jail terms of up to 20 years.
In his July 5 media statement, Dotcom continued: "To say that I am extremely disappointed by the decision of the Court of Appeal today is an understatement".
In his 2017 ruling, Gilibert accepted this argument but argued that Dotcom was eligible for extradition anyway, reasoning that "willful infringement of copyright can properly be characterized as a dishonest act".
The court found all of the pathways are available to the U.S., and it "has tendered sufficient evidence to support their case on those pathways", the court said in a statement accompanying the decision.
