Only a "Mandela moment" will stop Ashwin Willemse from going to the equality court, Willemse's lawyer told the Mail & Guardian.

Willemse confirmed through his legal representatives on Wednesday that he would approach the Equality Court for relief following the findings which cleared his colleagues Mallett and Naas Botha of racism.

Willemse walked off the SuperSport set last month following comments apparently made by his fellow presenters‚ complaining he felt patronised.

"We expressed a view to Adv Maleka SC that he (Adv Maleka SC) was being used to sanitise and chlorinate failures by SuperSport to deal with a number of reported incidents of racism by the gentlemen in question‚" Mlilo said.

In Maleka's 50-page report into the matter he states that Willemse "declined" to be interviewed and writes: "The essence of the reasons (given by Willemse) are that the incident was rooted in racism and he informed the CEOs of his submission to that effect".

It's also noted Japan supporters carried out a similar job following their participation in the 2014 World Cup in Brazil.

The report found that the conduct of Mallett and Botha "does not manifest naked racism and was not motivated by racist considerations".

Just when you think you might have some kind of closure, following SuperSport's independent review findings, there's another twist in the tale.

He is planning to go head-to-head with SuperSport.

Mallett and Botha are expected to resume their duties in due course, and Willemse's contract is still valid, SuperSport said.

Willemse implied on live TV that there was racism in sports broadcasting, and said he refused to work with people who "undermine" others.
