Alex Iovine, 26, and her girlfriend, Emma Pichl, 24, were riding with the auto service on Saturday evening in Manhattan when the driver suddenly pulled over and told them to get out of the vehicle.

A spokesman for the taxi regulator in NY said: "There is a list of circumstances that are grounds for refusing service to a passenger and what happened is definitely not one of them".

Iovine and Emma Pichl were taking the Uber from Pig Beach Gowanus to the East Village on Saturday when Iovine gave Pichl a kiss.

A similar incident occurred in Houston last December, when a gay couple claimed an Uber driver dropped them off at the side of a freeway after they kissed in his auto.

"We were sitting on opposite sides of the vehicle", Iovine recalled to the New York Daily News. "He yelled at us for being disrespectful and inappropriate because we pecked on the lips". "Nothing is illegal. It is not illegal to kiss in NY". "You are not allowed to do this", he can be heard saying.

An Uber spokeswoman told ABC News that they are in touch with the women and investigating the incident.

Iovine presses him to explain, asking: 'Why are we not allowed to kiss in an Uber?'

The driver says: "It's illegal".

According to Ms Pichl, Ms Iovine also filed a complaint with the city's Human Rights Commission in connection to the incident which took place during Pride Month.

The couple, who say they had been drinking but weren't drunk, recorded a cellphone video showing the driver, 35-year-old Ahmed Elbotari, booting them from his vehicle.

A confrontation between an uber driver and a same-sex couple was recorded on video. CNN reached out to the couple about el Boutari's claims. The women told CNN Uber refunded their $15 fare.

'We are investigating and will take appropriate action'.

The Taxi & Limousine Commission, which is responsible for regulating Uber and other ride-hail apps, did not immediately respond to Newsweek's request for comment.
