Emily Weinman Speaks Out Following Controversial Wildwood Beach Arrest

"As County Prosecutor, I recognize that the video footage has raised a lot of questions regarding the officers' actions", Cape May County Prosecutor Jeffrey H. Sutherland said in the news release. Kind of upset, just, the negative things people say about me.

"One situation doesn't define someone", Emily said.

Video of the arrest showed police approached the 20-year-old Weinman on May 26 for having unopened alcohol on the beach before the encounter devolved into a clash that was captured in a bystander's video viewed millions of times. Weinman says she cooperated with police, but after giving two breathalyzer tests which she says came back negative, the officers would not leave.

Police said that Weinman struck the officer before he tried to handcuff her, something Weinman denies. "I knew in my rights, I didn't have to give them my name".

The bodycam video shows Weinman walking away from the officers, with one warning her that she is "about to get dropped".

Weinman, who lives in Philadelphia, is on probation for a simple assault charge from 2016. It was only after the video of her violent arrest went viral that she was slapped with the more serious charge of assaulting a police officer.

The objective of the preliminary investigation was to determine whether the Professional Standards Unit ("PSU") of the Cape May County Prosecutor's Office would conduct the Internal Affairs investigation based on possible criminal charges against the arresting officer (s), or whether the Wildwood Police Department would conduct an Administrative Internal Affairs Investigation.

"The Saturday she was taken into custody, she was in custody for about 40 minutes, she was charged with misdemeanors". As to the spitting, Weinman alleged that she had gotten sand in her mouth after her head was pushed into the ground by the officer, and so she subsequently "turned around to spit it out".

She said her neck and back have been hurting since the incident, and she has headaches.

They say the video shows the woman assaulting the officers first.

Officials in Wildwood, where the incident took place, said they made the decision to avoid charges after reviewing body camera footage and a cellphone video, which went viral last week. Weinman then is seen spitting toward the officers.

Wildwood police issued a Wednesday evening statement saying their internal affairs probe into the arrest is ongoing, and Weinman will be given an opportunity to participate in that process.
