The attorneys general emphasize that citizenship was not included in the list of topics for the 2020 Census submitted to Congress on March 28, 2017, and that the question has not undergone any field testing.

The Trump administration made a decision to add the citizenship question late in the process for developing the 2020 questionnaire, and the Commerce Department chose to add the question despite research from the Census Bureau concluding that such a change to the questionaire could depress response rates, which the lawsuit filed Tuesday also notes. "Adding a citizenship question to the Census form has a deliberate and intended chilling effect on participation", Rosenblum said.

New York Attorney General Attorney General Eric Schneiderman announced the new lawsuit.

Healey previously led a coalition of attorneys general in sending a letter to the U.S. Bureau of the Census, urging the agency to reject the request by the U.S. Department of Justice to add a question about citizenship to the 2020 census.

Census tallies are used to determine the distribution of representation and resources, including the number of seats in the U.S. House of Representatives, the number of electoral college votes, and the apportionment of hundreds of billions of federal dollars each year. "In return, they rightfully expect to receive our state's fair share of federal funding for our roads and schools and an appropriate number of representatives in Congress".

The cities of New York City, Chicago, Philadelphia, Providence, San Francisco and Seattle are also plaintiffs, as is the bipartisan U.S. Conference of Mayors.

NY representatives plan to hit the Trump administration from all sides: Last month, Representative Carolyn B. Maloney, a Democrat, introduced the 2020 Census Improving Data and Enhanced Accuracy (IDEA) Act, legislation that would "protect the integrity of the census" in the face of the administration's attempts to amend it. Last month Attorney General Jeff Sessions announced a lawsuit against California over policies that the administration says hinder federal immigration authorities from enforcing USA immigration laws.

The attorney general said it is estimated that a 1 percent undercount on the 2010 Census would have resulted in less than $23 million in federal funding for Oregon.

The census does not plan to ask immigration or legal status.

"This is a blatant effort to undermine the census", Schneiderman said in a press conference announcing the lawsuit, adding that the lawsuit filed by several states will block the decision to include the citizenship.

"The United States Constitution requires a full count of all residents, whether they are citizens or not", said Shapiro.
