Stormy Daniels' motion to depose Trump, Cohen denied

A US federal judge has rejected a bid by a lawyer for adult film actress Stormy Daniels to question President Donald Trump under oath about their alleged 2006 affair and a $130,000 hush payment to her just before the 2016 election to keep quiet about the alleged liaison.

Stormy Daniels, whose real name is Stephanie Clifford, had been seeking to invalidate the non-disclosure agreement she signed days before the 2016 presidential election and offered to return the US$130,000 she was paid to "set the record straight".

According to court documents obtained by The Blast, Daniels' motion for Expedited Jury Trial and for Limited Expedited Discovery was denied.

Avenatti tweeted that he expects Cohen to file that request "any day".

Attorneys for Trump and Cohen did not immediately respond to messages seeking comment about Otero's order Thursday.

Daniels argues the agreement is legally invalid because it was only signed by Daniels and Cohen, but was not signed by Trump. "This does not bode well for the president or Mr. Cohen, and all indications are that when this motion is heard on the merits, we're going to get the discovery and we're going to get the trial we've asked for".

The new question comes at the request of the Justice Department which said it was needed to better enforce the Voting Rights Act. Cuomo raised the possibility that the census question will "undermine the accuracy and legitimacy of Census data".

As previously reported, Daniels, 39, has alleged that she had a sexual relationship with Trump, 71, in 2006.

Daniels on Monday added Cohen as a defendant in her lawsuit, claiming that he defamed her by suggesting she was a liar.

Cohen claims that he made the $130,000 payment out of his own pocket and outside of the Trump Organization, the Trump family business where he has worked.

Renato Mariotti, a former federal prosecutor from Chicago, said that if Trump was indeed unaware of a hush agreement with Daniels, the agreement was probably not valid.

David Schwartz, an attorney for Cohen, argued Thursday that the lawyer "never told" Trump about the agreement.

"The parties are advised that the instant litigation is not the most important matter on the court's docket", Otero wrote in a footnote attached to the four-page order.
